The service
SprayCan is an AI video tool, operated by Kamase Labs Inc. (“Kamase Labs”, “we”, “us”), that lets you create a visual persona from photos and generate new videos that recreate the format of a publicly available social-media video with your persona swapped in. These terms are an agreement between you and Kamase Labs Inc. By creating an account or using the service you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the service.
Eligibility & your account
You must be at least 18 years old to use SprayCan — the service creates realistic synthetic media of people, and we don’t offer it to minors. Provide accurate sign-in information, keep your sign-in method secure, and don’t share your account. You’re responsible for all activity on your account, including every video generated under it.
Credits
Actions in the studio consume credits: new accounts currently receive 100 free credits, AI persona generation costs 10 credits, and a video job costs 30 credits. Regenerating a delivered job is free, up to three regenerations per job. If a job fails on our side, its credits are automatically refunded to your balance.
Credits are tied to your account, aren’t transferable, and have no cash value. Credit amounts, prices, and the free allowance may change prospectively. If we later offer purchased credits, purchased credits will — except where required by law — not be refundable once used.
Your content: rights you must hold
This is the most important section of these terms. Read it before you submit anything.
Every time you submit a video link for cloning or upload a photo, you represent and warrant to Kamase Labs that:
- you own the content, or you hold all rights, licenses, consents, releases, and permissions needed for us to download, copy, store, modify, and process it and to generate derivative media from it as described in these terms;
- for every person whose face, body, voice, or other likeness appears in a photo you upload or a video you submit, that person is you, or you have their express permission (or another lawful basis) to use their likeness to create AI-generated media;
- neither your submission nor the output you asked for infringes or misappropriates any third party’s copyright, trademark, privacy, publicity, or other rights; and
- your submission of the content doesn’t violate the terms of the platform it came from.
SprayCan is a tool that processes content at your direction, on the assumption that these representations are true. We don’t review your submissions in advance and we can’t verify rights or consent on your behalf. You — not Kamase Labs — are solely responsible for the content you submit and for any claim that it, or the media generated from it, infringes someone else’s rights.
Likeness & consent
SprayCan generates photo-realistic synthetic media of real people (“digital replicas”). A growing body of law — federal and state right-of-publicity, digital-replica, and synthetic-media statutes — restricts creating or distributing a realistic replica of a person’s likeness or voice without their consent. You are responsible for complying with every such law that applies to you.
The safe way to use SprayCan is with your own likeness or a likeness you have written permission to use. If a person shown in your persona photos or generated videos withdraws consent, stop using their likeness and delete the affected personas and media. Some jurisdictions also require you to disclose that media is AI-generated; where that applies, disclosure is your obligation.
Prohibited uses
You agree not to use SprayCan to create, or to use SprayCan output for:
- Impersonation without consent — depicting a real person who hasn’t consented, or presenting generated media as an authentic recording of a real person or event;
- Deception and fraud — scams, phishing, fake endorsements or testimonials, market or political disinformation, or deceptive content about elections, health, or emergencies;
- Sexual content of real people — any sexually explicit or intimate imagery of a real, identifiable person;
- Anything involving minors — uploading photos of minors, creating personas of minors, or generating any content depicting minors;
- Harassment and harm — harassing, defaming, intimidating, blackmailing, or bullying any person;
- Infringement — violating anyone’s intellectual-property, privacy, or publicity rights, or the terms of the platform a source video came from;
- Abuse of the service — circumventing credit metering, rate limits, or access controls, probing or disrupting our systems, or accessing other users’ accounts or data.
We may remove content and suspend or terminate accounts that we reasonably believe violate this section, without notice or refund of consumed credits.
Generated content
As between you and Kamase Labs, you own the images and videos SprayCan generates for you, and we assign you whatever rights we hold in them. You’re free to use them commercially, subject to these terms and to the rights of others — owning the output doesn’t launder a likeness or a copyrighted work you had no right to use.
AI output can be inaccurate, imperfect, or similar to output generated for someone else, and purely AI-generated material may not be protectable by copyright. We make no promises that output is unique, copyrightable, error-free, or fit for any particular purpose. How you use it — including any legally required synthetic-media disclosures — is on you.
License you grant us
You keep ownership of the photos you upload and the videos you submit. You grant Kamase Labs a worldwide, non-exclusive, royalty-free license to download, host, store, reproduce, modify, and process that content, and to transmit it to the service providers who run our pipeline (listed in the Privacy Policy), solely to operate, provide, secure, and improve the service for you. The license ends when you delete the content or your account, except for copies our providers or the law require us to retain briefly.
We don’t use your photos, videos, or generated media to train our own AI models, and we don’t publish or market with them without your separate permission.
Third-party platforms
SprayCan is not affiliated with, endorsed by, or sponsored by Instagram, Meta, or TikTok. When you paste a link, we fetch only publicly accessible content, at your direction. Source videos belong to their creators and are governed by the platform they live on; submitting a link doesn’t give you — or us — any rights in them beyond what you already hold. You’re responsible for complying with the platforms’ terms when you submit source content and when you post generated content back to them.
Copyright complaints (DMCA)
We respect copyright and respond to notices under the Digital Millennium Copyright Act. If you believe content on SprayCan infringes your copyright, email griffin@hirebarry.com with the subject “DMCA notice” and include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL or other identification of the infringing material; (d) your contact information; (e) a statement that you have a good-faith belief the use isn’t authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the notice is accurate and that you’re the owner or authorized to act for the owner.
We’ll remove or disable access to material identified in a valid notice expeditiously and notify the user who submitted it, who may send a counter-notice with the corresponding statutory elements. We terminate the accounts of repeat infringers. The same address handles takedown requests for likeness misuse — if a SprayCan-generated video depicts you without your consent, tell us and we’ll act on it promptly.
Indemnification
You agree to indemnify, defend, and hold harmless Kamase Labs Inc. and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) content you submit to or generate with the service; (b) your breach of these terms, including the representations in sections 04 and 05; (c) your violation of any law or of any third party’s rights, including intellectual-property, privacy, and publicity rights; or (d) your use or distribution of generated media.
Disclaimers
The service and all generated content are provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, and any warranty about accuracy, availability, or that generation results will meet your expectations. Video generation depends on third-party AI providers and can fail, degrade, or change without notice.
Limitation of liability
To the maximum extent permitted by law, Kamase Labs’ total liability for any claims arising out of or relating to the service is limited to the greater of the amount you paid us in the three months before the claim and US$50. We’re not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, even if advised of the possibility. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
Termination
You can stop using the service and request account deletion at any time (see the Privacy Policy for how). We may suspend or terminate accounts that violate these terms — especially sections 04, 05, and 06 — or abuse the service. On termination, unused free credits lapse and your license to us ends as described in section 08; sections 04, 05, 07, and 10–15 survive.
Governing law & disputes
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Before filing any claim, you agree to try to resolve it informally by emailing griffin@hirebarry.com and giving us 30 days to respond. Any dispute not resolved informally will be settled by binding individual arbitration administered by the Vancouver International Arbitration Centre (VanIAC) under its applicable rules then in effect, seated in Vancouver, British Columbia, and conducted in English, rather than in court — except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. You and Kamase Labs each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these terms.
Changes
We may update these terms; material changes will be posted here with an updated date, and continued use after changes means you accept them.
